Warranty and Exclusions
ESD warrants full title of all products sold. ESD does not manufacture any of the products and accordingly cannot and does not warrant or guarantee their performance, function, or non-infringement of third party rights. ESD will pass to you any manufacturer's warranties for products purchased by you, to the extent permitted, and will use commercially reasonable efforts to assist you in presenting and processing any claims against the manufacturer under such warranty. Manufacturer warranties may not be available if the product
(1) fails due to improper modifications, improper handling, improper installation, improper removal or improper repairs by persons other than ESD or its authorized representatives;
(2) is accidentally damaged, or subjected to abuse or improper use;
(3) is altered or damaged such that ESD cannot verify the defect with normal test equipment; or
(4) has had its markings altered or removed.
To the extent permitted by law ESD excludes all express and implied warranties and all liability, whether direct, indirect, special or consequential, arising from negligence or otherwise relating to the use of this website, any inaccurancies and for any non-compliance by any products with any representations, illustrations, specifications, product features, colour or other information contained on this website. Where, by law, ESD is not permitted to exclude its liability but is permitted to limit its liability, its liability will be limited to, at its discretion, refunding the price of the products or providing, replacing or repairing those products again (except for goods of a kind ordinarily acquired for personal, domestic or household use or consumption, in respect of which ESD liability is not limited by virtue of this provision). Nothing in these terms and conditions should be taken to limit the operation of the statutory warranties implied under the Trade Practices Act 1974 (Cth) or related consumer protection laws.
ESD is not responsible for the contents of the websites that are maintained by third parties and therefore waives its liability for any links from this website to other websites.
Returns Policy
You must report to ESD, within 3 days after receipt of each shipment, any shortage, wrong parts, damage, and loss of products delivered. All returned products must be accompanied by the original invoice and be unused, resaleable (unless damaged or defective) and still in the original, undamaged package. ESD will accept no returns on electrical parts or special orders. ESD will charge you a 10% restocking fee for returns resulting from customer error. Freight charges will not be refunded. Defective items will be replaced or credited. ESD does not guarantee products which become defective due to improper installation or improper use. ESD's return policy does not cover competition or off road use.
